Consider and take appropriate action on acceptance of real estate in lieu of mitigation for Heritage Oaks residential project in Georgetown, Texas.

Background

The attached settlement agreement between US Fish and Wildlife Service (FWS) and Shel-Jenn, Incorporated, covers actions related to Heritage Oaks, a residential subdivision in Georgetown, Texas. Under the agreement Shel-Jenn will convey two preserve areas, Duckworth Bat Cave and Cat Cave, to the Williamson County Conservation Foundation (WCCF). Accompanying this conveyance, in lieu of other settlement, Shel-Jenn will provide a fee of $21,600 to the WCCF for future monitoring activities and a one-time voluntary contribution to the WCCF of $25,000. The Heritage Oaks subdivision will be enrolled in the county's Habitat Conservation Plan (HCP).

Attached are a draft copy of the settlment agreement between Shel-Jenn and the FWS and a scientific document outlining the conditions of Heritage Oaks and the two preserve areas.

No changes are expected to the draft settlement agreement. Acceptance by the county is a pre-condition of the settlement.

Upon notification of the settlement, a Determination Letter will be issued recapitulating these terms (to be accepted by Shel- Jenn) and a Participation Agreement will be issued to enroll the Heritage Oaks subdivision in the HCP.
