Consider and take appropriate action regarding policies concerning Commercial Use of Parks.
Background
On July 12, 2005 the Commissioners Court approved a general policy for minor commercial use of parkland. The policy is concerned with minor commercial ventures that are conducting classes/business for profit at park facilities. Examples of such existing enterprises are: a gentleman who does military style conditioning that uses the track, the trail, and the field areas at the Regional Park to conduct the training but charges a fee to his customers for his services. Another advertises and conducts scheduled runs on the Regional Trial on a weekly basis during the summer. He charges $10 per runner in a timed event and has close to 70 runners in each weekly event. Currently the existing policy allows the Parks and Recreation Director to collect a fee of not less than 10% for these small private enterprises using public parkland for a profit when the annual amount collected is less than $2,500. Should the annual percentage to the County exceed that amount we will work with purchasing to prepare a bid document for that particular service. Since that time we have had good compliance with the policy but with a few questions from time to time. The attached guidelines will clarify and add some specifics to the policy. A simple contract will be will be issued through our reservation system. Both the guidelines and contract have been changed and approved by Hal Hawes in the County Attorney’s office.
