Discuss, consider and take appropriate action on an Amendment to Residential Lease between Williamson County and George R. Bell regarding the residence located at 9769 HWY 29 W, Georgetown, Texas 78628.
Background
The Residential Lease subject of this item was awarded to George R. Bell following an Invitation for Bids process that was conducted in 2012. Following the Initial Term of the Residential Lease, Williamson County, as Landlord, and George R. Bell, as Tenant, agreed to extend the Residential Lease for two additional and separate terms of twelve (12) months each in accordance with the terms of the Residential Lease. On June 12, 2014 and prior to the expiration of the current Extension Term of April 1, 2014 to March 31, 2015, George R. Bell requested that Williamson County accept his early termination of the Residential Lease to be effective on or about August 31, 2014. Williamson County consented to his termination request.
George R. Bell thereafter requested that such termination be rescinded and that the Residential Lease continue for the remainder of the current Extension Term (see attached letter from George R. Bell). The proposed amendment would set forth the parties’ agreement to reinstate the current Extension Term of the Residential Lease until its expiration and termination date of March 31, 2015.
George R. Bell also asked for consent to sublet the premises during the current Extension Term pursuant to Paragraph 12 of the Residential Lease. The proposed amendment would allow George R. Bell to sublet the premises during the Extension Term, which terminates on March 31, 2015, provided that (a) he discloses the name of the subtenant to Williamson County prior to any such subletting; (b) his subtenant obtains all insurance required under the Residential Lease and provides Williamson County with a certificate evidencing the required insurance coverage since he will not be able to maintain insurance; and (c) Williamson County has no objections as to his subtenant.
Except as otherwise set forth in the amendment, George R. Bell will remain obligated for compliance with all terms, conditions and covenants under the Residential Lease and Williamson County would continue to look solely to George R. Bell for performance of all such terms, conditions and covenants under the Residential Lease.
