Modification to the Inter-Governmental Services Agreement between ICE and Williamson County
Submitted By: Peggy Vasquez, County Judge
Department: County Judge
Agenda Category: Regular Agenda Items

Agenda Item
Discuss and take appropriate action on Modification No. DROIGSA-10-0002 P00005 to the Inter-Governmental Services Agreement between Immigration and Customs Enforcement and Williamson County.
Background
The modification removes the word "drug" in Article I, Paragraph A of the IGSA. The remaining restrictions that prohibit the housing of residents that have been charged with criminal violations or that have known violent criminal histories will still apply.

The revised Article I, Paragraph A is as follows:

Article I. Purpose A. Purpose: The purpose of this Intergovernmental Service Agreement is to establish an Agreement between ICE and the Service Provider for the detention and care of alien females who are eighteen (18) years of age or older detained under the authority of Immigration and Nationality Act, as amended. All persons in the custody of ICE are “Administrative Detainees”. This term recognizes that ICE residents are not charged with criminal violations, have no known violent criminal histories and are only held in custody to assure their presence throughout the administrative hearing process and to assure their presence for removal from the United States pursuant to a lawful final order by the Immigration Court, the Board of Immigration Appeals or other Federal judicial body.
