Agenda Item
Discuss and consider authorizing County Judge to execute Lease and Parkland Improvement Agreement between The City of Austin and Williamson County, Texas for Brushy Creek Regional Trail, contingent upon final review by County Attorney's office.
Background
The lease agreement between the City of Austin and Williamson County provides for access, construction and maintenance of a section of the Brushy Creek Regional Trail (BCRT). This phase of construction on the BCRT extends the existing trail from its current terminus just east of
Parmer Lane along Brushy Creek to a point in Twin Lakes Park, just east of US 183. A section of this trail passes through a tract of land owned by the City of Austin, being a tract conveyed to the City as a green space and described as:

"All that certain tract of land situated in Williamson County, Texas, generally described as 37.34 acres of land, more or less, out of and part of the Samuel Damon Survey, Abstract No. 170, and being a portion of that 591.144 acre tract identified as Parcel One, Tract II, conveyed to Pebble Creek Joint Venture by Deed recorded as Document No. 9843836 in the Official Records of Williamson County, Texas; said 37.34 acres of land being more particularly described in a Special Warranty Deed recorded as Document No. 2005103350, Official Records of Williamson County, Texas."

This tract is referenced in the Agreement as the Pebble Creek Tract.

The initial draft has been reviewed by the county attorney and this draft has been forwarded to the City of Austin. No substantive changes are expected from City of Austin attorneys. The requested action is to authorize the County Judge to execute the agreement following a final review by the Williamson County Attorney. This action is requested due to the limited time frame for reimbursement by Texas Parks and Wildlife, which is providing grant funding for this project.
