Receive consultation and seek legal advice regarding available options to support county operations, including the legal authority and alternatives pertaining to site regulation and/or zoning authority over landfills for health and safety purposes pursuant to Tex. Health & Safety Code § 363.112 and § 364.012 (Executive Session as per VTCA Gov’t Code Section 551.072 – Real Property Matters & VTCA Gov’t Code Section 551.071 – Attorney Consultation).

Background

Proposed regulations (one of the few areas where counties have "zoning authority" will prohibit further creation of new landfills in the unincorporated areas (unless a variance is granted or an exception applies). Will need to set a public hearing first and publish notice in the paper. Per statutory directive, only county "residents" may testify at such a public hearing. Tex. Health & Safety Code § 363.112 and § 364.012.
