Discuss and take appropriate action regarding a Standard Utility Agreement with Atmos for utility relocation on IH 35 Northbound Frontage Road (NBFR) Project and reimbursement of the relocations.

Background

Atmos has existing facilities inside the right of way, which are in conflict with the proposed construction. The existing facilities to be relocated include 597 feet of 4” poly gas line in 8” steel casing and appurtenances with an abandonment of 850 feet of existing line. Atmos has chosen to relocate their entire crossing of the IH 35 ROW but only 27% the relocation is reimbursable since only 165 feet of the total length in conflict with the improvements on the IH 35 NBFR within the Interstate ROW. The total cost of the relocation is estimated at $213,216.36, with $57,568.42 (27%) being reimbursed by the County. Atmos has agreed to begin that work as soon as the agreement is executed.
