Discuss and take appropriate action on approving the Williamson County Nonconsent Towing Rules and Regulations.

Background

Many of the Williamson County towing companies are requesting that the non-consent rotation tow fees/rates be increased. The fees/rates that towing companies in Williamson County are currently operating under were set in October of 2006. These fees are set out in the enclosed Williamson County Nonconsent Towing Rotation List Agreement.

Mr. Jody Robinson (former owner of Glass Wrecker Company) has acted as the towing companies’ representative and has provided the county with a recent study on towing rates in Texas (See Morningside Report – December 2012).

Nonconsent tows consist of towing vehicles that have been in wrecks, cars that were driven by individuals that have been arrested, etc. The county does not pay the tow fees. Rather, they are paid by the owners of the vehicles or their insurance companies. However, the Commissioners Court must set the tow rates/fees.

If the Commissioners Court approves the Williamson County Nonconsent Towing Rules and Regulations, such Rules and Regulations would supplant the current Williamson County Nonconsent Towing Rotation List Agreement and the new rates/fees would then be authorized for each towing company that signs and provides the necessary documents (See Exhibit “C” of the Rules and Regulations). The new Rules and Regulations also provide revisions that were necessary due to recent changes in the law.
