Discuss, consider and take appropriate action on authorizing the County Judge to sign a Certificate of the Judge of Williamson County, Texas with respect to the issuance by the Arlington Higher Education Finance Corporation of its Education Revenue Bonds in accordance with the requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended.

Background

This certificate is solely for the purposes of the approval requirements of Section 147(f) of the IRC. Since there is a campus located in Williamson County (the “County”), Section 147(f) of the Internal Revenue Code states that the “highest elected official” of the jurisdiction containing the project site must approve the transaction after a public hearing is held. The public hearing was held on September 11, 2014 at 9:30 A.M. at the law offices of Andrews Kurth LLP, 111 Congress Avenue, Suite 1700, Austin, Texas 78701; there were no attendees. Bond counsel is now seeking now the approval of the highest elected public official for this jurisdiction.

The loan will not be a debt or liability of the County. The consent being requested herein is only for the purposes of complying with the federal tax law regarding tax-exempt financing.
