Discuss and take appropriate action to suspend or terminate the Agreement for Construction Services for Improvements to the Brushy Creek Regional Trail - Bid Number 12IFB00009 between Williamson County and Myers Concrete Construction, L.P.
Background
On April 17, 2012 during the regular session of Commissioners Court, Myers Concrete Construction, LP was awarded the bid for Brushy Creek Trail Improvements Bid #12IFB00009 because they were the best overall bid meeting specifications. Since that time, the Williamson County Parks & Recreation Department received correspondence from the Upper Brushy Creek Water Control Improvement District (WCID) detailing modernization work that is mandated by the State of Texas, through the Dam Safety Program and the Texas Commission on Environmental Quality. It appears the planned modernization and construction on the dam may adversely affect the portion of Brushy Creek Regional Trail currently included in our trail improvement project, jeopardizing the permanent improvements that were planned for this section of trail. The Dam modernization project is still in design and the WCID is committed to further coordination with the County and our representatives to ensure that trail and continued public service interests are considered and met – to include possible detour routes for times when the trail must be closed.
