Discuss and consider approving construction agreement with Kraftsman, L.P. for the water play components for the Southwest Regional Park Splash Pad and consider increasing the contract amount by $12,600 for a Warranty Bond.

Background

This AGREEMENT BETWEEN OWNER AND CONTRACTOR is the formal agreement between Kraftsman, L.P. and the County on construction of the water play components of the Southwest Regional Park Splash Pad approved in court on March 16, 2010. Hal Hawes of the County Attorney’s Office crafted the document. Also requested is an increase in the contract amount by $12,600 to provide for a warranty bond for the project. A warranty is included in the scope but a warranty bond was suggested by the County attorneys to cover any circumstance of a disagreement in repairs or should the company go out of business. The warranty bond quote is on page 36 of 45 on the attached agreement.
