Consider exempting District Clerk from three business day deposit requirement and allow monies collected for the County to be deposited no later than seven business days pursuant to Code Of Criminal Procedures Art. 103.004, subsections (a) and (b).
Background
Several county offices have placed this on the agenda and had it approved over the past several years.  These offices include, but are not limited to Justice of the Peace's Precincts 1-4, Constable's Precincts 1-4, and divsions of the County Attorney, County Clerk, and Sheriff's Office.  The Code of Criminal Procedure 103.004 states
(a) Except as provided by subsections (b) and (c), an officer who collects recognizances, bail bonds, fines, forefeitures, judgements, jury fees, and other obligations recovered in the name of the state under any provision of this title shall deposit the money in the county treasury not later than the next regular business day after the date that the money is collected.  If it is not possible for the officer to deposit the money in the county treasury by that date, the officer shall deposit the money in the county treasury as soon as possible, but not later than the third regular business day after the date that the money is collected.
(b) The comissioners court of a county may authorize an officer who is required to deposit money under Subsection (a) to deposit the money in the county treasury not later than the seventh regular business day after the date that the money is collected.
