Discuss and consider authorizing overtime up to a total of $5,500 and approving the related line item transfer to pay non-exempt County Attorney employees
Background
Currently if a non exempt employee in the County Attorney’s office works overtime they will receive comp time rather than being paid for the time worked. Our office is currently working on 2 projects that are in the need to have overtime paid.
The first is a Hot Check warrant round up. A project of this magnitude involves preparing cases, coordinating with Crimestoppers, working with the merchants, media, law enforcement agencies as well as extensive research to find the criminal offender. We will be targeting over 100 cases for arrest. Task needed to accomplish this can not be completed during normal business hours due to daily workload.
The second project is keeping up with the Michael Morton Act that went into effect January 1, 2014. Our workload and volume of evidence received increased by 400-500% from previous years and current staff can not handle this type of increase without extra hours/manpower. This law change requires our office to request and receive all evidence from law enforcement, then log and duplicate and finally get it to the defense attorney on the case BEFORE a case is plead out. We are needing to have staff work more hours to accomplish this task. Giving comp time to employees would not benefit our office needs as that would still have our staff out at other times.
