Agenda Item
Consider and take appropriate action on a resolution for a Multiple Use Agreement (MUA) with Texas Department of Transportation (TxDot) for the Berry Springs Trail under I-H 35 Bridge.
Background
A portion of Phase III of the Berry Springs Trail will pass under I-H 35 along Berry Creek on the north side of the creek. TxDot has expressed their willingness to approve our use but has asked for a resolution on their standard Multiple Use Agreement (MUA) to be approved by the County. The resolution allows the County Judge to sign the MUA upon completion with concurrence from the County Attorney. The attachments are the Court resolution, an example of the MUA that will be completed by TxDOT, Exhibit A which shows the project location, and Exhibit B shows metes and bounds description.
TxDOT will use the information to evaluate and prepare the MUA and return for our signature. This review and approval process usually takes around 30 days as the document is circulated among various offices at TxDOT.
