49. Discuss and take appropriate action on the County Landfill.
  Judge Gattis made a statement that during Executive Session there was discussion on the landfill and questions raised by parties opposing our 1405B permit application. To clarify what I believe to be the standing of this court I quote from a letter dated September 18, 2007, written to Glen Shankle, Executive Director of Texas Commission on Environmental Quality (TCEQ), The Commissioners' Court wants to clearly communicate that it wishes to relieve any confusion associated with the existing permit or the permit which would be issued pursuant to the above-referenced application. We want this record to be clear on Williamson County’s intent to be the sole applicant for the 1405-B permit, and that only Williamson County is the permittee, site Owner, and Site Operator. Waste Management is a contractor to the county. To the extent possible under law, we would ask that this intent be incorporated into the permit as issued by the TCEQ.

In addition it is my belief that the State Office of Administrative Hearings (SOAH) Judges in this case stated and I concur and believe the court to agree that Williamson County is Owner of the Permit, site Owner, the site Operator and under present agreement Waste Management is the operator.

I sincerely hope this settles the issue in the public eye and we wait for final ruling from TCEQ on the permit.

50. Comments from Commissioners.
  Commissioner Birkman asked Commissioner Morrison to arrange to give a presentation on how much recycling is being done at the Lanfill.

Commissioner Morrison replied that last month was the largest month in volume and dollars due to selling metal.  He said he would arrange for a progress report to the Court in the near future.

Commissioner Long reaffirmed that the County's intention in regards to the landfill has been according to the statement made today by the Judge.

Commissioner Covey commented that she would like to see a Hazardous Waste Day scheduled for the County.

Judge Gattis noted that our contractor paid for one Hazardous Waste retrieval per year and it could be put on a future Agenda for discussion and action.

Commissioner Birkman and Long said the cities have their own plans for Hazardous Waste retrieval and the County could cooperate with them.

Judge Gattis said it would be good for each Commissioner to discuss cooperation on Hazardous Waste with the cities and put this on a future Agenda.

Commissioner Covey asked if the prices for individuals going to the Landfill with waste had changed or if Waste Management had approached the Judge to change these prices.

Judge Gattis said they had not approached him in this regard.
