Discuss and take appropriate action on a letter to the Environmental Protection Agency (EPA) concurring with proposal from the Clean Air Coalition (CAC) on implementation under ozone standards.
Background
The EPA has not finally determined, under a review of the 2008 National Ambient Air Quality Standards (NAAQS), nor announced new standards for calculating ground level ozone. EPA's own failure to meet original announced deadlines has created a situation where comments on implentation of new standards are nearly being required before any announcement on the standards themselves. EPA is scheduled to announce new standards in March. In its regualrly scheduled meeting on February 9 the Clean Air Coalition of Central Texas (CAC) passed a proposal addressing implementation standards. 

The short version is that EPA has the authority to implement standards under one of two Subparts of the Clean Air Act, either Part 1 or Part 2. Part 1 provides for greater flexibility to local governments and planning agencies in meeting whatever new standards are set.

This letter is to support the proposal of the CAC.

Attachments to this agenda item include the draft letter, authorities under the Subpart from the Federal Register and a discussion of the Subpart 1 advantages prepared by Capital Area Council of Governments Air Quality staff.
