1. Read and approve the minutes of the last meeting.

Motion: To approve the minutes of the last meeting with changes:
To approve sending the Proposed 2009 Landfill Operation Agreement draft with the changes as proposed by our attorneys to Waste Management and to encourage Waste Management Inc. to approve the contract as soon as possible, returning it to the Commissioners Court for final approval. 

Page 28 Section 4.4 (b) Waste Volume and Origination Limits - Change to use the Texas Commission on Environmental Quality (TCEQ) definition which includes (changed from excludes) construction and demolition debris and treatment plant sludge.

Hear County Auditor concerning invoices, bills, Quick Check Report, and Wire Transfers submitted for payment and take appropriate action including, but not limited to approval for payment provided said items are found by the County Auditor to be legal obligations of the county.

Commissioner Birkman abstained in regards to invoice for Gabriel's Funeral Chapel. (Conflict of Interest Affidavit attached)

COMMISSIONERS’ COURT RECONVENED FROM EXECUTIVE SESSION AT 1:00 P.M. ON TUESDAY, FEBRUARY 10, 2009. The County Judge announced that no action was taken in the executive session.

COMMISSIONERS’ COURT RECESSED AT 1:01 P.M. to allow two members of the Court to participate in a negotiation meeting. The remaining three members of the Court did not engage in any deliberations on county business during the recess.

COMMISSIONERS’ COURT RECONVENED AT 4:06 P.M., when the full Court had returned from their other commitments.

COMMISSIONERS’ COURT RECESSED TO EXECUTIVE SESSION AT 4:07 P.M. to continue consultations with their attorneys concerning the county landfill.

COMMISSIONERS’ COURT RECONVENED FROM EXECUTIVE SESSION AT 4:42 P.M. The County Judge announced that no action was taken in the executive session. The Judge then made a brief statement about the formation of future agendas for possible action concerning the landfill and announced that a quorum of the Court would be attending the February 11 meeting of the Texas Commission on Environmental Quality, as previously posted.

  Commissioner Long commented that the re-striping of the south bound on-ramp on US 183 will begin Wednesday of this week.
