Discuss and take appropriate action on Determination Letter Re: Ronald Reagan Blvd., Phase III, between RM 2338 and SH 195. WCCF Application Number 20090218. Submitted for Somerset Hills Limited (Waterstone Development).

Background

Somerset Hills Limited has submitted a Participation Application (WCCF Application No. 20090218) for participation in the county's U.S. Fish and Wildlife Service (FWS) 10(a) permit. The subject area is the right of way and adjacent habitat for the extension of Ronald Reagan Blvd. between FM 2338 and SH 195. The right of way encompasses 128.6 acres over the covered karst zone. Indicated impact includes take of one karst feature (cave) and partial encroachment to other karst features. The subject area also covers 50.7 acres of direct and 47.4 acres of indirect impact to Golden-cheeked warbler (GCW) habitat. Calculation of mitigation participation fees as per the Williamson County Regional Habitat Conservation Plan (RHCP) for karst and bird habitat is $435,290 and $520,800 respectively, for a total of $956,090.

The applicant has proposed donation of land in lieu of fees for the karst mitigation and a financial plan for monetary payment of the GCW mitigation fees. The attached Determination Letter outlines the terms of the land donation and the payment plan.

The letter format has been reviewed separately by counsel for the Foundation and for the County. The land to be donated has been determined by FWS to be a Karst Fauna Area as defined under the RHCP and will be a key component of the county's species recovery plan.
