Consider and take appropriate action on Resolution to Implement and Enforce State Rule for Locally Enforced Motor Vehicle Idling Limitations and on Implementation Plan for the Texas Heavy-Duty Vehicle Idling Rule.
Background
Under the Austin/Round Rock MSA 8-Hour Ozone Flex Program approved by Williamson County and other local governmental entities the county agreed to a Memorandum of Agreement (MOA) for the Local Early Action Compact. As a part of the MOA the county agrees to implement certain actions under 30 TAC Chapter 114 which deals with motor vehicle idling limitations. These rules prohibit vehicles with GVW over 14000 pounds from idling for more than five consecutive minutes during the April 1 to October 31 period, such time being known as the "ozone season." The rules are applicable only within jurisdiction of a local government that has signed a MOA and Section 7.352 of the Texas Water Code dictates that civil remedies are enabled only after the local government adopts a resolution. The MOA has an expiration date of December 31, 2013.
Further, the rules require adoption of a specific implementation plan outlining.
The county attorney's office has reviewed this resolution and the implementation plan.
