Discuss and take appropriate action regarding the supplemental to the utility agreement with Georgetown Electric for the relocation of the existing facilities near the FM 2243 intersection on the IH 35 Northbound Frontage Road (NBFR) Project.

Background

Georgetown Electric (GTE) had existing facilities inside the right of way which were in conflict with the proposed construction. The existing facilities have been relocated and re-attached to the City of Georgetown’s new poles located around the FM 2243 intersection within the Interstate ROW. The original agreement included an underground crossing of IH 35. The supplemental to the agreement reflects a subsequent change to an overhead crossing, and includes facilitating the relocation of AT&T and Suddenlink lines across IH 35. This supplemental will increase the reimbursement cap to a not to exceed amount of $363,363.34, an increase of $23,262.22 from the original agreement. As stated in the agreement, “The parties agree that the approval of estimated costs in no way indicates the eligibility of said costs for reimbursement.” Including these costs in the estimated reimbursement amount does not obligate the County to reimburse these items, but allows GTE the opportunity to submit these costs with their invoices for consideration. At this time, GTE has not officially submitted their final invoice to the County. Once the invoice is received from GTE, the Road Bond Team and the Auditor’s office will review all expenditures in detail for allowed and/or disallowed costs. The Auditor’s office has concurred with placement of this item on the agenda for consideration.
