Discuss and take appropriate action on Addendum to an Agreement with Beirne, Maynard & Parsons, L.L.P. to provide Legal Services for Williamson County in regards to complying with the Voting Rights Act; and exemption of those attorney services from the competitive bid/proposal requirements of the County Purchasing Act pursuant to the discretionary exemption for personal or professional services.

Background

The Williamson County Commissioners Court entered into an Agreement with Beirne, Maynard & Parson, L.L.P., on March 8, 2011 for Professional Redistricting Services. (Exhibit A) This Addendum (Exhibit B) is to hire Beirne, Maynard & Parson, L.L.P. at an hourly rate of $365.00 to provide all necessary legal services to represent the County in response and, if necessary, defense of litigation, arising out of the issues contained in the attached letter (Exhibit C) that was received by Rick Barron, Elections Administrator, dated March 14, 2011 from the Department of Justice.

In the letter, the Justice Department makes specific requests of the County to allegedly comply with the Voting Rights Act as it relates to the issues set forth in the Department of Justice letter. We feel professional services of a contractor are necessary to assist the County to comply with the obligations imposed by State in federal law.

Since this Addendum is for professional services, it is therefore exempt from the competitive bidding process under Chapter 262, of the Local Government Code.
